The Probate Process in North Carolina

Probate is the legal process whereby a deceased person's estate is administered and distributed according to their will or, in the absence of a will, according to state intestacy laws. 

North Carolina’s probate process typically follows these key steps:

  • Filing the will and opening the estate. If the deceased had a valid will, it must be filed with the Clerk of Superior Court in the county of residence.

  • Paying debts and expenses. The estate is responsible for settling outstanding debts, taxes, and administrative costs. This may include publishing a notice to creditors to allow legitimate claims to be made.
  • Distributing the estate. After paying debts and expenses, the remaining assets are distributed to beneficiaries or heirs.
